Johnson & Johnson (Thailand) Ltd. ("Company") cares about your privacy and wants you to be familiar with how we collect, use, and disclose information.  This Privacy Policy describes our practices in connection with information that we or our service providers collect through the website or application (hereinafter the "Service") operated and controlled by us from which you are accessing this Privacy Policy.  By providing personal information to us or by using the Service, you acknowledge that you have read and understand this Privacy Policy.

USE BY MINORS

The Service is not directed to individuals under the age of 20, and we request that these individuals not provide personal information through the Service. If your child has submitted Personal Information and you would like to request that such Personal Information be removed, please contact us as explained below under Contacting Us.

INFORMATION COLLECTION

We may ask you to submit personal information in order for you to benefit from certain features (such as newsletter subscriptions, tips/pointers, or order processing) or to participate in a particular activity (such as sweepstakes or other promotions).  You will be informed what information is required and what information is optional.

If you submit any personal information relating to another individual to us, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

SENSITIVE INFORMATION

Unless we specifically request or invite it, we ask that you not send us, and you not disclose, any sensitive personal information (e.g., information related to racial or ethnic origin, political opinions, religion or philosophical beliefs, health, sex life or sexual orientation, criminal background, or trade union membership, or biometric or genetic data for the purpose of uniquely identifying an individual) on or through the Service

AUTOMATIC INFORMATION COLLECTION AND USE

We and our service providers may collect certain information automatically as you navigate around the Service.  Please read the Cookie Policy for detailed information about the cookies and other tracking technologies used on the Service.  The Cookie Policy includes information on how you may disable these technologies.  

We and our service providers may also automatically collect and use information in the following ways:

Through your browser: Certain information is collected by most browsers, such as your Media Access Control (MAC) address, computer type (Windows or Mac), screen resolution, operating system name and version, and Internet browser type and version.  We may collect similar information, such as your device type and identifier, if you access the Service through a mobile device.  We use this information to ensure that the Service functions properly.

IP address: Your IP address is a number that is automatically assigned to your computer by your Internet Service Provider.  An IP address is identified and logged automatically in our server log files whenever a user visits the Service, along with the time of the visit and the pages visited.  Collecting IP addresses is standard practice and is done automatically by many online services.  We use IP addresses for purposes such as calculating Service usage levels, diagnosing server problems, and administering the Service.  We may also derive your approximate location from your IP address.

Device Information:  We may collect information about your mobile device, such as a unique device identifier, to understand how you use the Service.

 

HOW WE USE AND DISCLOSE INFORMATION

We use and disclose information you provide to us as described to you at the point of collection.  Please see the section entitled “Choices and Access,” below, to learn how you may opt out of certain of our uses and disclosures.

Where required by applicable law, we will obtain your consent to our use of your personal information at the point of information collection.  We may also use information from or about you as necessary to enter into or perform a contract, to comply with a legal obligation (for example, due to our pharmacovigilance obligations), or for our legitimate business interests. Where any personal information is necessary for us to enter into or perform the contract, or to comply with the legal obligation, and you do not provide us with such necessary personal information for such purposes, we may not be able to perform or manage the contract, or to facilitate you. We may also rely on other legal bases, specifically for:

  • Providing the functionality of the Service and fulfilling your requests.
  • to provide the functionality of the Service to you and providing you with related customer service;
  • to respond to your inquiries and fulfill your requests, such as to send you documents you request or e‑mail alerts;
  • to send you important information regarding our relationship with you or regarding the Service, changes to our terms, conditions, and policies and/or other administrative information.

We will engage in these activities to manage our contractual relationship with you and/or to comply with a legal obligation.

  • Accomplishing our business purposes
    • for data analysis, for example, to improve the efficiency of the Service;
    • for audits, to verify that our internal processes function as intended and are compliant with legal, regulatory, or contractual requirements;
    • for fraud and security monitoring purposes, for example, to detect and prevent cyberattacks or attempts to commit identity theft;

    • for enhancing, improving or modifying our website or products and services;
    • for identifying Service usage trends, for example, understanding which parts of our Service are of most interest to users;
    • for determining the effectiveness of our promotional campaigns, so that we can adapt our campaigns to the needs and interests of our users;. And
    • for internal administrations purposes.

We will engage in these activities to manage our contractual relationship with you, to comply with a legal obligation, and/or because we have a legitimate interest.

  • Analysis of Personal Information to provide personalized services.
    • to better understand you, so that we can personalize our interactions with you and provide you with information and/or offers tailored to your interests;
    • to better understand your preferences so that we can deliver content via the Service that we believe will be relevant and interesting to you.

We will provide personalized services either with your consent or because we have a legitimate interest.

We also disclose information collected through the Service:

  • to our affiliates for the purposes described in this Privacy Policy. A list of our affiliates is available at https://johnsonandjohnson.gcs-web.com/financial-information/sec-filings (click on the link for Form 10K, Exhibit 21, under “SEC Filings”). Johnson & Johnson (Thai) Co. Ltd is the party responsible for the management of the jointly‑used Personal Information;
  • to our third party service providers who provide services such as website hosting and moderating, mobile application hosting, data analysis, payment processing, order fulfillment, infrastructure provision, IT services, customer service, e‑mail and direct mail delivery services, auditing, and other services, in order to enable them to provide services; and
  • as permitted by applicable law, to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).

In addition, we may use and disclose your information as we believe to be necessary or appropriate: (a) to comply with legal process or applicable law, which may include laws outside your country of residence; (b) as permitted by applicable law to respond to requests from public and government authorities, which may include authorities outside your country of residence; (c) to enforce our terms and conditions; and (d) to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or others.  We may also use and disclose your information in other ways, after obtaining your consent to do so.

We may use and disclose information we collect automatically as described above, under “Automatic Information Collection and Use."

In addition, where allowed by applicable law, we may use and disclose information that is not in personally identifiable form for any purpose.  If we combine information that is not in personally identifiable form with information that is identifiable (such as combining your name with your geographical location), we will treat the combined information as personal information as long as it is combined.

 

CHOICES AND ACCESS

Your choices regarding our use and disclosure of your personal information

We give you choices regarding our use and disclosure of your personal information for marketing purposes.  You may opt out from:

  • Receiving reminders from us: If you no longer want to receive medical reminders from us on a going‑forward basis, you may opt out of receiving them by contacting us by sending an email to ThailandPrivacy@its.jnj.com. In your response to us, please provide your name and the e‑mail address or phone number at which you receive reminders from us.

We will seek to comply with your request(s) as soon as reasonably practicable.  Please note that if you opt out as described above, we will not be able to remove your personal information from the databases of our affiliates with which we have already shared your information (i.e., as of the date that we implement your opt‑out request).  Please also note that if you opt out of receiving marketing‑related messages from us, we may still send you important transactional and administrative messages, from which you cannot opt out.

How you can exercise your rights relating to your personal information

As a data subject, you have the rights according to the Personal Data Protection Act B.E. 2562 (2019) including the following rights:

  • Right to withdraw consent: You have the right to withdraw consent given to us for collecting, using or disclosing your personal information at any time, unless there is a restriction of the withdrawal of consent by law or the contract which gives benefits to you. However, the withdrawal of consent shall not affect the processing of personal information you have already given consent to us legally.
  • Right to access: You have the right to request access to and obtain copy of your personal information, which is under our responsibility, including to request the disclosure of the acquisition of the personal information obtained without your consent.
  • Right to data portability: Where we arrange your personal information to be in the format which is readable or commonly used by ways of automatic tools or equipment, and can be used or disclosed by automated means, you have the right to receive your personal information and are also entitled to send or transfer your personal information in such formats to other data controllers stipulated by law.
  • Right to object: You have the right to object to the collection, use or disclosure of your personal information on grounds stipulated by law.
  • Right to Erasure: You have the right to request us to erase, destroy or make your personal information become unidentifiable data on grounds stipulated by law.
  • Right to restriction of processing: You have the right to request us to restrict the use of your personal information on grounds stipulated by law.
  • Right to rectification: You have the right to request us to modify your personal information to be accurate, up-to-date, complete, and not misleading.
  • Right to file a complaint: You have the right to file a complaint to a competent official under the Personal Data Protection Act B.E. 2562 anytime we violate or do not comply with the Personal Data Protection Act B.E. 2562.

If you would like to exercise your rights, please contact us via Webform.  We will respond to your request as soon as reasonably practicable and no later than one month after receipt. If circumstances cause any delay in our response, you will be promptly notified and provided a date for our response.

 

CROSS‑BORDER TRANSFER

Your personal information may be stored and processed in any country where we have facilities or service providers, and by using our Service or by providing consent to us (where required by law), your information may be transferred to countries outside of your country of residence, including to the United States, which may provide for different data protection rules than in your country. In sending or transferring such personal information, we will comply with the Personal Data Protection Act B.E. 2562, and ensure that appropriate contractual and other measures are in place to protect personal information when it is transferred to our affiliates or third parties in other countries,

 

SECURITY

We seek to use reasonable organizational, technical, and administrative measures designed to protect personal information under our control.  Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure.  If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you have with us has been compromised), please immediately notify us in accordance with the “Contacting Us” section below.

 

RETENTION PERIOD

We will retain your personal information for as long as needed or permitted in light of the purpose(s) for which it was obtained.  The criteria used to determine our retention periods include:  (i) the length of time we have an ongoing relationship with you and provide the Service to you; (ii) whether there is a legal obligation to which we are subject; and (iii) whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations).

  • แก่ผู้ให้บริการที่เป็นบุคคลภายนอกของบริษัทฯ ที่ให้บริการต่าง ๆ เช่น เจ้าของและผู้ควบคุมเว็บไซต์ เจ้าของแอปพลิเคชันอุปกรณ์เคลื่อนที่ การวิเคราะห์ข้อมูล การประมวลผลการชำระเงิน การปฏิบัติตามคำสั่ง การจัดหาโครงสร้างพื้นฐาน บริการไอที การบริการลูกค้า บริการส่งอีเมลและไดเร็กต์เมล การตรวจสอบ และบริการอื่น ๆ เพื่อให้ผู้ให้บริการภายนอกสามารถให้บริการได้ และ
  • แก่บุคคลภายนอก ตามที่ได้รับอนุญาตตามกฎหมาย ในกรณีที่มีการปรับเปลี่ยนโครงสร้างองค์กร การควบรวมกิจการ การขาย กิจการร่วมค้า การมอบหมาย การโอนหรือการจำหน่ายอื่น ๆ ของธุรกิจ สินทรัพย์ หรือหุ้นทั้งหมดหรือส่วนหนึ่งส่วนใดของบริษัทฯ (รวมถึงที่เกี่ยวข้องกับการล้มละลายหรือกระบวนการที่คล้ายกัน)

นอกจากนี้ บริษัทฯ อาจใช้และเปิดเผยข้อมูลของคุณตามที่บริษัทฯ เห็นว่ามีความจำเป็นหรือเหมาะสม: (ก) เพื่อปฏิบัติตามกระบวนการทางกฎหมายหรือกฎหมายที่ใช้บังคับ ซึ่งอาจรวมถึงกฎหมายนอกประเทศที่คุณอาศัยอยู่ (ข) ตามที่กฎหมายที่ใช้บังคับอนุญาตให้ตอบสนองต่อคำขอจากหน่วยงานสาธารณะและหน่วยงานของรัฐ ซึ่งอาจรวมถึงหน่วยงานที่อยู่นอกประเทศที่คุณอาศัยอยู่(ค) เพื่อบังคับใช้ข้อกำหนดและเงื่อนไขของบริษัทฯ และ (ง) เพื่อปกป้องสิทธิความเป็นส่วนตัว ความปลอดภัยหรือทรัพย์สินของบริษัทฯและ/หรือของบริษัทในเครือของบริษัทฯ คุณ หรือบุคคลอื่นใด  ทั้งนี้ บริษัทฯ ยังอาจใช้และเปิดเผยข้อมูลของคุณในรูปแบบอื่น ๆภายหลังจากที่ได้รับความยินยอมจากคุณ

บริษัทฯ อาจใช้และเปิดเผยข้อมูลที่บริษัทฯ เก็บรวบรวมโดยอัตโนมัติตามที่อธิบายไว้ข้างต้น ภายใต้หัวข้อ “การเก็บรวบรวมและใช้ข้อมูลโดยอัตโนมัติ"

นอกจากนี้ ในกรณีที่ได้รับอนุญาตตามกฎหมายที่บังคับใช้ บริษัทฯ อาจใช้และเปิดเผยข้อมูลที่ไม่สามารถระบุตัวบุคคลได้เพื่อวัตถุประสงค์ใด ๆ  หากบริษัทฯ นำข้อมูลที่ไม่สามารถระบุตัวบุคคลได้มารวมกันกับข้อมูลที่สามารถระบุตัวบุคคลได้ (เช่น การรวมชื่อของคุณเข้ากับที่ตั้งทางภูมิศาสตร์ของคุณ) บริษัทฯ จะถือว่าข้อมูลที่รวมกันนั้นเป็นข้อมูลส่วนบุคคล ตราบใดที่นำข้อมูลมารวมกัน

ทางเลือกของคุณเกี่ยวกับการใช้งานและการเปิดเผยข้อมูลส่วนบุคคลของคุณ

บริษัทฯ ให้ทางเลือกแก่คุณเกี่ยวกับการที่บริษัทฯ ใช้และการเปิดเผยข้อมูลส่วนบุคคลของคุณเพื่อวัตถุประสงค์ทางการตลาด  คุณสามารถปฏิเสธ:

การรับการแจ้งเตือนจากบริษัทฯ: หากคุณไม่ต้องการรับข้อมูลแจ้งเตือนทางการแพทย์จากบริษัทฯ อีกต่อไป คุณ สามารถปฏิเสธไม่รับข้อมูลแจ้งเตือนได้โดยติดต่อบริษัทฯ ด้วยการส่งอีเมลไปที่ ThailandPrivacy@its.jnj.com

ในการตอบกลับถึงบริษัทฯ โปรดระบุชื่อและที่อยู่อีเมลหรือหมายเลขโทรศัพท์ที่คุณได้รับการแจ้งเตือนจากบริษัทฯ.

บริษัทฯ จะพยายามดำเนินการตามคำขอของคุณโดยเร็วที่สุด ทั้งนี้ โปรดทราบว่าในกรณีที่คุณปฏิเสธความยินยอมตามที่อธิบายไว้ข้างต้น บริษัทฯ จะไม่สามารถลบข้อมูลส่วนบุคคลของคุณออกจากฐานข้อมูลของบริษัทในเครือของบริษัทฯ ซึ่งบริษัทฯ ได้แบ่งปันข้อมูลของคุณไปแล้วได้ (เช่น ณ วันที่เราดำเนินการตามคำขอปฏิเสธ)  และโปรดทราบว่าหากคุณปฏิเสธไม่รับข้อความทางการตลาดจากบริษัทฯ บริษัทฯ ยังคงสามารถส่งข้อความเกี่ยวกับการทำธุรกรรมและการบริหารจัดการที่สำคัญ ซึ่งคุณไม่สามารถปฏิเสธไม่รับได้

วิธีการใช้สิทธิของคุณที่เกี่ยวข้องกับข้อมูลส่วนบุคคลของคุณ

คุณมีสิทธิภายใต้บทบัญญัติของพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 รวมถึงสิทธิต่าง ๆ ดังนี้:

  • สิทธิในการเพิกถอนความยินยอม: คุณมีสิทธิขอเพิกถอนความยินยอมที่ให้ไว้แก่บริษัทฯ ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลของคุณเมื่อใดก็ได้ เว้นแต่การเพิกถอนความยินยอมจะมีข้อจำกัดโดยกฎหมายหรือสัญญาที่ให้ประโยชน์แก่คุณ ทั้งนี้การถอนความยินยอมจะไม่ส่งผลกระทบต่อการประมวลผลข้อมูลส่วนบุคคลที่คุณได้ให้ความยินยอมแก่บริษัทฯ ก่อนหน้าแล้วโดยชอบด้วยกฎหมาย
  • สิทธิในการเข้าถึงข้อมูลส่วนบุคคล: คุณมีสิทธิขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของคุณซึ่งอยู่ในความรับผิดชอบของบริษัทฯ รวมถึงขอให้บริษัทฯ เปิดเผยถึงการได้มาซึ่งข้อมูลส่วนบุคคลดังกล่าวที่คุณไม่ได้ให้ความยินยอม
  • สิทธิในการให้ส่งหรือโอนข้อมูลส่วนบุคคล: ในกรณีที่บริษัทฯ ได้ทำให้ข้อมูลส่วนบุคคลนั้นอยู่ในรูปแบบที่สามารถอ่านหรือใช้งานโดยทั่วไปได้ด้วยเครื่องมือหรืออุปกรณ์ที่ทำงานได้ โดยอัตโนมัติและสามารถใช้หรือเปิดเผยข้อมูลส่วนบุคคลได้ด้วยวิธีการอัตโนมัติ คุณมีสิทธิขอรับข้อมูลส่วนบุคคลของคุณจากบริษัทฯ ได้ รวมทั้งมีสิทธิขอให้บริษัทฯ ส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่นได้ตามที่กฎหมายกำหนด
  • สิทธิในการคัดค้าน: คุณมีสิทธิในการคัดค้านการประมวลผลข้อมูลที่เกี่ยวกับคุณสำหรับกรณีการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลได้ตามที่กฎหมายกำหนด
  • สิทธิในการลบข้อมูลส่วนบุคคล: คุณมีสิทธิขอให้บริษัทฯ ลบหรือทำลายหรือทำให้ข้อมูลส่วนบุคคลเป็นข้อมูลที่ไม่สามารถระบุตัวตนได้ด้วยเหตุตามที่กฎหมายกำหนด
  • สิทธิในการระงับการใช้ข้อมูลส่วนบุคคล: คุณมีสิทธิขอให้บริษัทฯ ระงับการใช้ข้อมูลส่วนบุคคลของคุณด้วยเหตุตามที่กฎหมายกำหนด
  • สิทธิในการขอแก้ไขข้อมูลส่วนบุคคลให้ถูกต้อง: คุณมีสิทธิขอให้บริษัทฯ แก้ไขข้อมูลส่วนบุคคลของคุณเพื่อให้ข้อมูลส่วนบุคคลดังกล่าวถูกต้อง เป็นปัจจุบัน สมบูรณ์ และไม่ก่อให้เกิดความเข้าใจผิด
  • สิทธิในการร้องเรียน: คุณมีสิทธิในการร้องเรียนต่อพนักงานเจ้าหน้าที่ผู้มีอำนาจตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคลพ.ศ. 2562 เมื่อบริษัทฯ ฝ่าฝืนหรือไม่ปฏิบัติตามพระราชบัญญัติดังกล่าวได้.

หากคุณต้องการใช้สิทธิของคุณ โปรดติดต่อบริษัทฯ ด้วยการส่งอีเมลพร้อมคำขอไปที่ เว็บฟอร์ม บริษัทฯ จะดำเนินการตอบคำขอของคุณโดยเร็วที่สุด และไม่เกินหนึ่งเดือนหลังจากได้รับคำขอ ในกรณีที่มีเหตุให้การตอบของบริษัทฯ เกิดความล่าช้า คุณจะได้รับการแจ้งเตือนทันที พร้อมวันที่จะได้รับการตอบกลับจากบริษัทฯ.

การโอนข้ามประเทศ

ข้อมูลส่วนบุคคลของคุณอาจได้รับการจัดเก็บและประมวลผลในประเทศที่บริษัทฯ มีกิจการหรือให้บริการ และจากการใช้บริการของบริษัทฯ หรือการให้ความยินยอมแก่บริษัทฯ (ตามที่กฎหมายกำหนด) ข้อมูลของคุณอาจถูกโอนไปยังประเทศนอกประเทศที่คุณอาศัยอยู่ รวมถึงประเทศสหรัฐอเมริกา ซึ่งอาจมีกฎการคุ้มครองข้อมูลที่แตกต่างไปจากในประเทศของคุณ ทั้งนี้ ในการส่งหรือโอนข้อมูลดังกล่าว บริษัทฯ จะปฏิบัติตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 และยืนยันว่าจะจัดให้มีมาตรการตามสัญญาและมาตรการอื่น ๆ ที่เหมาะสมเพื่อคุ้มครองข้อมูลส่วนบุคคล เมื่อถูกโอนไปยังบริษัทในเครือของบริษัทฯ หรือบุคคลภายนอกในต่างประเทศ

ความปลอดภัย

บริษัทฯ จะใช้มาตรการขององค์กร เทคนิคและการบริหารจัดการที่เหมาะสม ซึ่งออกแบบมาเพื่อปกป้องข้อมูลส่วนบุคคลที่อยู่ภายใต้การควบคุมของบริษัทฯ อย่างไรก็ดี การส่งข้อมูลผ่านอินเทอร์เน็ตหรือระบบจัดเก็บข้อมูลนั้นก็ยังไม่สามารถรับประกันความปลอดภัยได้ 100% หากคุณมีเหตุผลที่เชื่อได้ว่าการสื่อสารระหว่างคุณกับบริษัทฯ ไม่มีความปลอดภัย (เช่น หากคุณรู้สึกว่าบัญชีที่คุณมีกับบริษัทฯ  มีความปลอดภัยต่ำกว่ามาตรฐาน) โปรดแจ้งให้บริษัทฯ ทราบทันทีตามหัวข้อ “ติดต่อเรา” ด้านล่าง.

ระยะเวลาการเก็บรักษาข้อมูล

บริษัทฯ จะเก็บรักษาข้อมูลส่วนบุคคลของคุณตราบเท่าที่จำเป็นหรือได้รับอนุญาตตามวัตถุประสงค์ที่ได้รับข้อมูลมา  เกณฑ์ที่ใช้ในการกำหนดระยะเวลาการเก็บรักษาข้อมูลของบริษัทฯ ประกอบด้วย: (1) ระยะเวลาที่บริษัทฯ มีความสัมพันธ์อย่างต่อเนื่องกับคุณและให้บริการแก่คุณ (2) ข้อกำหนดทางกฎหมายที่บริษัทฯ ต้องปฏิบัติตาม และ (3) การเก็บรักษาข้อมูลตามสถานะทางกฎหมายของบริษัทฯ (เช่น ในเรื่องอายุความที่บังคับใช้ การดำเนินคดีหรือกระบวนการตรวจสอบทางกฎหมาย)

เว็บไซต์และบริการของบุคคลภายนอก

นโยบายความเป็นส่วนตัวนี้ไม่ได้ระบุถึงและบริษัทฯ จะไม่รับผิดชอบต่อความเป็นส่วนตัว ข้อมูลหรือวิธีปฏิบัติอื่น ๆ ของบุคคลภายนอก รวมถึงบุคคลภายนอกที่ให้บริการเว็บไซต์หรือบริการออนไลน์ใด ๆ (รวมถึงแต่ไม่จำกัดเฉพาะ แอปพลิเคชันใด ๆ) ที่สามารถเข้าถึงได้ผ่านบริการนี้หรือที่บริการนี้ที่มีลิงก์ไปถึง การให้เข้าถึงหรือการรวมลิงก์ไปยังเว็บไซต์หรือที่อยู่ดังกล่าวในบริการไม่ได้หมายถึงการรับรองของบริษัทฯ หรือบริษัทในเครือของบริษัทฯ
